By downloading, installing, or using Trekka Outdoors ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
We reserve the right to modify these terms at any time. Your continued use of the App after any changes constitutes acceptance of the new terms.
2. Description of Service
Trekka Outdoors is a professional outdoor activity tracking application that provides:
- GPS-based activity tracking and recording with 120+ metrics
- Health and fitness metrics monitoring via Apple HealthKit
- Route planning, GPX import, and navigation
- Offline map functionality
- Storm alarm and safety features
- Standalone Apple Watch tracking
- Live Activity and workout mirroring
- Ghost Racer and bike computer modes
The App is designed for personal use to track outdoor activities such as hiking, running, cycling, climbing, and other fitness activities.
3. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable law or regulation
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App to track activities in restricted or dangerous areas without proper authorization
- Use the App in a manner that could damage, disable, or impair the App
4. Safety & Liability
IMPORTANT: Trekka Outdoors is a tracking and navigation tool, not a safety device. The App should not be relied upon as your sole means of navigation or safety in outdoor activities.
- Always carry appropriate safety equipment and inform others of your plans
- GPS accuracy can vary and may be affected by weather, terrain, and device limitations
- The App does not guarantee accuracy of location data, maps, or route information
- You are solely responsible for your safety when using the App
- We are not liable for injuries, losses, or damages resulting from use of the App
- Storm alarm and safety features are aids, not guarantees — always exercise independent judgment
Use the App at your own risk. Always exercise caution and good judgment when engaging in outdoor activities.
5. Data & Privacy
All data collected by the App is stored locally on your device. We do not collect, transmit, or store your personal data on external servers.
- You are responsible for backing up your data
- We are not responsible for data loss due to device failure, app deletion, or other circumstances
- HealthKit integration is subject to Apple's HealthKit terms and privacy policies
- Location data is used only for activity tracking and stored locally

6. Intellectual Property
The App, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws.
- All rights, title, and interest in the App remain with Trekka
- You are granted a limited, non-exclusive, non-transferable license to use the App
- You may not copy, modify, distribute, or create derivative works
- Map data and third-party content are subject to their respective licenses
7. Third-Party Services
The App may integrate with third-party services, including:
- Apple HealthKit for health data
- Map providers for map data and navigation
- Apple's iCloud for optional data synchronization
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
8. App Availability
We strive to keep the App available and functioning, but do not guarantee:
- Uninterrupted or error-free operation
- Compatibility with all devices or OS versions
- Availability of all features at all times
- Accuracy of GPS, maps, or other data
We reserve the right to modify, suspend, or discontinue any part of the App at any time.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF DATA
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
- PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM USE OF THE APP
- ERRORS OR INACCURACIES IN GPS DATA, MAPS, OR ROUTE INFORMATION
Our total liability shall not exceed the amount you paid for the App, if any.
11. Indemnification
You agree to indemnify and hold harmless Trekka, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your activities while using the App
12. Termination
We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice. You may stop using the App at any time by uninstalling it. Upon termination, your right to use the App ceases immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Trekka operates, without regard to conflict of law provisions.
