4. Safety and Liability

IMPORTANT: Trekka Outdoors is a tracking and navigation tool, not a safety device. The App should not be relied upon as your sole means of navigation or safety in outdoor activities.

Always carry appropriate safety equipment and inform others of your plans
GPS accuracy can vary and may be affected by weather, terrain, and device limitations
The App does not guarantee accuracy of location data, maps, or route information
You are solely responsible for your safety and the safety of others when using the App
We are not liable for any injuries, losses, or damages resulting from your use of the App

Use the App at your own risk. Always exercise caution and good judgment when engaging in outdoor activities.

5. Data and Privacy

All data collected by the App is stored locally on your device. We do not collect, transmit, or store your personal data on external servers.

You are responsible for backing up your data
We are not responsible for data loss due to device failure, app deletion, or other circumstances
Your use of HealthKit integration is subject to Apple's HealthKit terms and privacy policies
Location data is used only for activity tracking and is stored locally on your device

All rights, title, and interest in the App remain with Trekka

Map data and third-party content are subject to their respective licenses

7. Third-Party Services

The App may integrate with third-party services, including:

Apple HealthKit for health data
Map providers for map data and navigation
Apple's iCloud for optional data synchronization

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

8. App Availability

We strive to keep the App available and functioning, but we do not guarantee:

Uninterrupted or error-free operation
Compatibility with all devices or operating system versions

Accuracy of GPS, maps, or other data

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM USE OF THE APP
ERRORS OR INACCURACIES IN GPS DATA, MAPS, OR ROUTE INFORMATION

Our total liability shall not exceed the amount you paid for the App, if any.

11. Indemnification

You agree to indemnify and hold harmless Trekka, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Your activities while using the App

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including violation of these Terms.

You may stop using the App at any time by uninstalling it from your device. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Trekka operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts of that jurisdiction.
